How the six- and 12-plant limits work

One qualifying adult may have up to six plants, with three or fewer mature and flowering. When multiple qualifying adults live together, the dwelling may contain up to 12 plants total and six mature and flowering. The household limit does not increase when a third adult moves in.

The Alaska Marijuana Control Board also makes clear that assisting another adult or organizing multiple personal grows cannot be used to avoid commercial licensing requirements.

Check the property rules

Alaska’s adult-use law does not require every private property owner to allow a grow. A landlord, employer or another entity that owns, occupies or controls the property may prohibit or regulate marijuana possession, use or cultivation on that property. Review the lease and obtain clear permission before installing equipment.

Keep the project personal

The adult may keep the harvest of the lawful plants on the premises where it was grown. That protection does not authorize selling the harvest or combining several people’s personal allowances into an unlicensed commercial garden.

Before you start

1. Confirm property permission. Review owner, lease and building rules.
2. Count the whole dwelling. Stay within both total and mature-flowering limits.
3. Meet the visibility rule. Under AS 17.38.030, members of the public must not be able to see the plants without binoculars, aircraft or other viewing aids.
4. Secure the plants. Take reasonable precautions against unauthorized access to the plants, as required by AS 17.38.030; keep children and visitors away.
5. Plan electrical safety. Use correctly rated circuits, lights and environmental equipment.
6. Keep it noncommercial. Do not sell or pool personal grows into a business.
