Terms of Use

These Terms of Use (“Terms”) govern your access to and use of HWGrow.com, including public content, accounts, memberships, Ask HWGrow, Grow Journals, Community Chat, comments, Highlight Gallery, purchases, and related services (collectively, the “Services”). By using the Services, creating an account, purchasing a membership, or completing Community Chat onboarding, you agree to these Terms.

1. Adults 21+ Only

You must be at least 21 years old to create an account, purchase a membership, post to the community, or otherwise use member features. By using those features, you represent that you are 21 or older. If HWGrow reasonably believes you are under 21, HWGrow may permanently terminate your access.

2. Legal Compliance and Educational Purpose

HWGrow provides educational, informational, community, and entertainment content relating to horticulture, cannabis cultivation, equipment, and related subjects. Laws vary by location and change over time. You are solely responsible for knowing and complying with all laws, regulations, lease terms, workplace rules, and other obligations that apply to you.

Nothing on HWGrow is legal, medical, financial, safety, or other professional advice. Content, community posts, journal entries, chatbot responses, and member comments may be incomplete, inaccurate, outdated, or inappropriate for your circumstances. Do not rely on HWGrow as a substitute for qualified professional advice where professional advice is appropriate.

3. Accounts, Login, and Public Display Names

Your email address is the primary member login identifier. Your public display name is what other people see on HWGrow and is not a login credential. You are responsible for maintaining control of your email account, password, login codes, and active sessions.

You may not impersonate HWGrow, staff, moderators, another person, or another organization. HWGrow may reserve or block brand, staff, moderator, misleading, offensive, or otherwise inappropriate public display names and may change or remove a display name that violates these Terms.

Six-digit email codes are temporary authentication credentials. Do not share them. HWGrow may rate-limit or disable login methods when abuse or security risks are detected.

4. Free, Supporter, and Masterclass Access

Different features require different access levels. Free logged-in accounts may receive features such as Ask HWGrow, comments, and Community Chat posting after onboarding. Supporter and Masterclass products may add additional content, journal privileges, media privileges, or other features described on the applicable product page.

Paid-program entitlements do not automatically unlock unrelated paid programs unless HWGrow expressly says otherwise. Product descriptions and checkout terms control the specific access included with a purchase.

5. Recurring Memberships and Payments

If a product is described at checkout as recurring, you authorize the applicable payment processor to charge the displayed recurring amount at the displayed interval until the subscription is canceled or otherwise ends. The price, billing interval, trial terms if any, cancellation method, and included access shown at checkout are part of these Terms.

Cancellation stops future entitlement according to the applicable subscription rules but does not necessarily erase past orders, billing records, public content, or other information that HWGrow lawfully retains. Refunds, if any, are governed by the terms shown at purchase, applicable law, and any separately stated HWGrow refund policy.

6. Public Nature of Journals, Chat, Comments, and Highlights

Grow Journals, public comments, Community Chat, and Highlight Gallery are community/public features. Do not treat them as private communications. Logged-out visitors may be able to watch Community Chat and like eligible photos. Public Grow Journals may be searchable and indexed by search engines.

Community Chat is designed as temporary rolling conversation, but HWGrow does not promise deletion at an exact time. Retention may vary based on system settings, storage, backups, moderation, security, technical issues, or legal requirements.

7. Community Rules

In addition to these Terms, Community Chat users must follow the Community Rules presented during onboarding. At a minimum:

  1. You must be 21 or older.
  2. No selling, arranging sales, or posting unlawful or prohibited goods or services. No outside links except where HWGrow expressly permits them.
  3. No spam, unauthorized self-promotion, advertisements, server invites, or repetitive cross-posting.
  4. No age-restricted sexual content, nudity, obscene content, graphic violence, or similarly disturbing content.
  5. Do not post personal or identifying information about yourself or anyone else. Stay anonymous for your own safety.
  6. No hateful conduct, targeted harassment, threats, or abusive behavior. Constructive criticism is welcome; attacks are not.
  7. Report content that violates the rules or makes you feel unsafe.
  8. Search HWGrow tutorials or ask the chatbot before posting a repetitive question. Do not cross-post the same question in multiple rooms.
  9. Avoid vague, context-free questions such as “Any suggestions?” or “How are my plants looking?” without enough information for others to help.
  10. Do not copy and paste AI-generated answers as your own advice. HWGrow may remove content that appears to be automated, misleading, or unreliable.

HWGrow may update these rules to address new abuse patterns or community needs.

8. Prohibited Conduct

You may not use the Services to:

  • break the law, facilitate illegal transactions, or evade legal restrictions;
  • sell or solicit cannabis, controlled substances, prohibited goods, or other unlawful products or services;
  • post malware, phishing content, malicious code, or deceptive links;
  • harass, threaten, stalk, dox, exploit, or endanger another person;
  • post another person’s private information without authorization;
  • post hateful, obscene, sexually explicit, or graphically violent material prohibited by the Community Rules;
  • spam, scrape, overload, interfere with, reverse engineer, or automate access to the Services in a way HWGrow has not authorized;
  • manipulate likes, Highlight thresholds, reports, referrals, rewards, rankings, or community metrics;
  • circumvent bans, rate limits, access controls, paid entitlements, or moderation systems;
  • infringe copyright, trademark, privacy, publicity, or other rights.

9. User Content Ownership and License to HWGrow

You retain ownership of original content you submit, subject to rights you have granted to others. You are responsible for ensuring you have the rights necessary to upload or post it.

By submitting public content to HWGrow, you grant HWGrow a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, format, resize, compress, transcode, crop, excerpt, quote, and otherwise technically process that content as reasonably necessary to operate, moderate, back up, secure, promote, and improve the Services.

For public Grow Journals, this license includes the right to link to, feature, quote, excerpt, summarize, or create editorial article drafts or features based on public journal material, with attribution to the public display name where reasonably appropriate.

For photos posted to Eye Candy Pics, you understand that an eligible photo that reaches the then-current community-like threshold, or is otherwise approved by HWGrow, may be copied into the permanent HWGrow Highlight Gallery. HWGrow may crop or reformat the photo, add a non-invasive public-display-name overlay, include it in vertical reels or compilations, and display or distribute those Highlight versions through HWGrow websites and HWGrow-controlled social-media accounts. Unless HWGrow separately announces a reward, contest, or written compensation agreement, Highlight selection does not entitle you to payment or prizes.

HWGrow will not claim that it created your original user content merely because you granted this license. This license does not override rights that cannot lawfully be waived.

10. Content You Should Not Upload

Do not upload content containing private addresses, precise location data, identification documents, account credentials, medical records, financial data, license plates, faces or identifying information you do not have permission to publish, or anything else that could create a safety or privacy risk. HWGrow may resize or re-encode images and attempt to strip metadata, but you remain responsible for what is visible in the image itself.

11. Automated Moderation, Reports, and Enforcement

HWGrow may use automated, rule-based, and human moderation. Automated systems may identify spam, sales, links, personal information, threats, hate, explicit material, duplicate posting, rate abuse, or other risky behavior. Lower-confidence content may trigger a warning, temporary hold, rate limit, or request to edit rather than an immediate ban.

Moderation tools are not perfect. HWGrow does not promise that every violation will be detected or that every moderation decision will be error-free. We may remove, hold, limit, restrict, edit visibility of, or refuse to distribute content; issue warnings or timeouts; revoke posting privileges; ban accounts or network identifiers; or take other reasonable action to protect the community or Services.

HWGrow may act without advance warning in serious or repeated cases. A decision not to remove one item does not waive our right to remove similar or different content later.

12. No Duty to Monitor; Third-Party Content

User content is created by members and visitors, not by HWGrow. HWGrow does not endorse or guarantee community content and is not responsible for the accuracy, legality, safety, quality, or usefulness of user-submitted advice, links, photos, journals, comments, or chat messages. You interact with other users and rely on user content at your own risk.

13. Amazon and Other Affiliate Links

HWGrow participates in affiliate programs and may earn commissions from qualifying purchases. Amazon or other product links appearing in journals, chat, articles, or other content may be replaced, redirected, or normalized through HWGrow’s affiliate-link system. By posting a permitted Amazon product link, you understand that HWGrow may apply its affiliate tracking tag to the destination.

Affiliate compensation does not guarantee a positive review or endorsement. Disclosures may also appear near affiliate content where appropriate.

14. Highlight Likes, Rankings, and Future Promotions

Likes and Highlight eligibility are community features, not guarantees of value, popularity, payment, prizes, or future rewards. HWGrow may change thresholds, detect or disregard suspicious likes, hold a photo for review, reject manipulated activity, or modify or discontinue Highlight or reward programs. Any future contest or reward program may have separate rules.

15. Ask HWGrow and Human Help

Ask HWGrow may use automated systems to answer questions from available HWGrow content. Automated responses can be wrong or incomplete. Human help, when offered, is not guaranteed and may be limited by availability. Neither automated nor human responses replace professional advice or your responsibility to make safe and lawful decisions.

16. Intellectual Property

Except for user content and third-party material, the Services and HWGrow-created text, video, images, graphics, branding, software, databases, compilations, and other materials are owned by or licensed to HWGrow and are protected by applicable intellectual-property laws. You may not reproduce, distribute, republish, sell, scrape, or commercially exploit HWGrow content except as authorized in writing or permitted by law.

17. Third-Party Services

HWGrow may depend on third-party services such as payment processors, hosting providers, login providers, email services, Amazon, video hosts, or other integrations. HWGrow does not control those third parties and is not responsible for their availability, security, content, or practices.

18. Service Availability and Data Loss

The Services are provided on an “as available” basis. Features may change, be suspended, experience downtime, or be discontinued. Although HWGrow may use backups and safeguards, you are responsible for keeping copies of content that is important to you. HWGrow does not guarantee permanent storage of chat, journals, photos, comments, drafts, messages, or other data.

19. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT, RESULTS, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

HWGROW DOES NOT GUARANTEE GROW RESULTS, YIELDS, SAFETY, LEGAL COMPLIANCE, PRODUCT PERFORMANCE, COMMUNITY ADVICE, CHATBOT ANSWERS, OR THE ACCURACY OF USER CONTENT.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HWGROW AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, CROPS, PLANTS, PROPERTY, OR BUSINESS OPPORTUNITY; OR DAMAGES ARISING FROM USER CONTENT, COMMUNITY INTERACTIONS, THIRD-PARTY SERVICES, UNAUTHORIZED ACCESS, DATA LOSS, MODERATION DECISIONS, OR RELIANCE ON INFORMATION PROVIDED THROUGH THE SERVICES.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

21. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless HWGrow and its owners, officers, employees, contractors, and affiliates from claims, damages, losses, liabilities, and reasonable costs arising from your unlawful conduct, your violation of these Terms, your user content, your infringement of another person’s rights, or transactions or arrangements you attempt to conduct through the Services.

22. Suspension and Termination

HWGrow may suspend or terminate access, remove content, revoke community privileges, or apply account/network restrictions when we reasonably believe it is necessary for safety, security, legal compliance, abuse prevention, payment issues, or enforcement of these Terms. Serious violations may result in permanent bans without warning.

23. Changes to the Services or Terms

HWGrow may modify features, rules, prices for future billing periods, or these Terms. The “Last updated” date identifies the current version. Where appropriate, material changes may be presented through the site or account experience. Continued use after an effective update constitutes acceptance to the extent permitted by law; where fresh affirmative consent is appropriate, HWGrow may require it.

24. Governing Law

These Terms are governed by applicable United States federal law and, to the extent applicable, the laws of the state in which the HWGrow operating entity maintains its principal place of business, without regard to conflict-of-law principles. Any mandatory rights you have under applicable consumer law remain unaffected.

25. Severability and Entire Agreement

If a provision is found unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law. These Terms, the Privacy Policy, the Copyright/DMCA page, applicable Community Rules, and any product-specific checkout terms form the agreement governing the applicable Services.
