Is It Legal to Grow Cannabis at Home in Maine? (2026 Rules)
Jurisdiction: Maine | Last verified: September 4, 2026 | Program: Adult personal cultivation
Quick answer: Yes. A Maine adult age 21 or older may cultivate up to six mature cannabis plants, 12 immature plants and an unlimited number of seedlings for personal adult use. Cultivation may take place on the home parcel, other land the grower owns, or another owner’s land with a written agreement permitting cultivation and care. Plant limits apply across locations, with required tags, youth-access precautions and applicable local rules.
Maine home-grow rules in plain language
- Minimum age: 21.
- Mature plants: six per qualifying adult.
- Immature plants: 12 per qualifying adult.
- Seedlings: no numerical limit under the adult personal-use provision.
- Location: the home parcel, other land the grower owns, or another owner’s land with a written agreement permitting cultivation and care.
- Youth access: take reasonable precautions to prevent access by anyone under 21.
- Plant tags: each mature and immature plant requires a legible identification tag.
- Local rules: comply with applicable municipal or land-use regulations.
What the plant tag must include
Each mature and immature plant must carry a legible tag with the grower’s name, driver’s-license or identification number, and a notation that the plant is being grown for personal adult use under Maine law. If someone else owns the parcel, the tag must also identify that owner.
The statute does not require the same tag on seedlings, but keeping every tray and plant clearly labeled still makes the grow easier to audit as seedlings move into the immature category.
Local governments may regulate the grow
A Maine municipality may regulate adult home cultivation and may limit the total mature plants on a parcel. However, its rule must still allow six mature plants, 12 immature plants and unlimited seedlings for each qualifying adult domiciled there. Unorganized and deorganized areas may have Maine Land Use Planning Commission rules instead.
Medical cultivation is separate
Maine’s medical-use cultivation rules apply to qualifying patients, caregivers and registered caregivers separately. Do not substitute the adult personal-use limits for a medical grow or combine plant counts without checking the current medical rules for the people and property involved.
Before you start
- Confirm the location. Use the home parcel, other land you own, or another owner’s land with a written agreement permitting cultivation and care. Count plants across all locations.
- Check local rules. Review municipal or Land Use Planning Commission requirements.
- Prepare the tags. Label every mature and immature plant with all required information.
- Restrict youth access. Use locks, fencing or another effective barrier appropriate to the location.
- Track plant stages. Recount as seedlings become immature and immature plants become mature.
